Heath <br />Code Enforcement Officer <br />DATE: November 10, 1992 <br />SUBJECT: RELEASE OF EASEMENT REQUEST BY: <br />JAMES A. -MOBIL <br />RIVERWALx II SUBDIVISION <br />It is requested that the data herein presented be givent1ormal <br />consideration by the Board of County Commissioners at their regular <br />meeting of November 17, 1992. <br />DESCRIPTION AND CONDITIONS: <br />The County has been petitioned by James A. Nobil, owner of the <br />subject property, for the release of the 40 foot easterly marginal <br />access easement and the northerly fifteen (15) foot utility <br />easement of Riverwalk II Subdivision. It is the petitioner's <br />intention to construct a retail sales complex on the subject <br />property. The petitioner will formally dedicate new easements to <br />the County prior to this abandonment being recorded, <br />The current zoning classification of the subject property is CG, <br />General Commercial District. The Land Use Designation is <br />Commercial/Industrial. <br />ALTERNATIVES AND ANALYSIS: <br />The request has been reviewed by Southern Bell Telephone Company, <br />florida Power and Light Company, Falcon Cable Corporation, the <br />Indian River County Utilities Department and the Road and Bridge <br />and Engineering Divisions. Based upon their reviews, it is staff's <br />Position that the subject easement may be released with the <br />condition that the applicant dedicate new utility and marginal <br />access easements to the County before a formal abandonment is <br />recorded in the public records. <br />RECOMMENDATION: <br />Staff recommends that the Board, through the adoption of a <br />resolution, release the northerly fifteen (15) foot utility <br />easement and the easterly forty (40) foot marginal access, utility <br />and drainage easement of Riverwalk II Subdivision, Plat Book 12, <br />Page 36, of the Public Records of Indian River County, Florida. <br />Staff recommends that the release of easements not be recorded <br />until the applicant has dedicated new marginal access, utility and <br />drainage easements to the County as described herein. <br />13 <br />NOV 1992 i <br />BOOK F: rE 1 <br />
