Collins II - Deputy County Attorney <br />DATE: December 18, 1991 <br />SUBJECT: Notice to Applicants Regarding Lobbying of Board Members <br />Pursuant to Board direction at the 12/17/91 meeting, I would advise that you <br />provide a notice to all applicants for permits. from your department in <br />essentially the following form: <br />"A recent court case has held that lobbying of board <br />members outside of regularly scheduled meetings may <br />nullify development approvals. You should have no <br />contacts with the Board of County Commissioners, <br />Planning and Zoning Commission, or Board of <br />Adjustment, or Building Code Board of Adjustment and <br />Appeals regarding the following: <br />Special Exceptions <br />Variances <br />Site Plans <br />Subdivision Plats <br />You, are free to contact your representatives regarding <br />rezoning and comprehensive plan amendments outside of <br />the -public hearing process . * This is due to the <br />distinction that rezonings and comprehensive plan <br />amendments are essentially changing the rules under <br />which development occurs and are considered legislative <br />in nature. The prohibited areas of lobbying involve <br />situations where the rules are established and the boards <br />make findings as to whether or not you satisfy all the <br />criteria of the rules." <br />WGC/nhm <br />Discussion ensued regarding changing the meeting times from <br />daytime to evenings, and Chairman Eggert expressed her opposition <br />to it. She noted that even though you think more people will come <br />to a meeting in the evening, they don't.
