NOV 2 4 1997 BOOK <br />88 fmU 12!1 <br />Attorney Vitunac confirmed that following this suggestion <br />would be setting a precedent and that it would be better to adhere <br />to our ordinance. <br />Director Pinto recommended letting interest accrue on the past <br />due amount of approximately $95,000 and escrow the payments for <br />future bills. He added that if the Board decided to adhere to the <br />County Ordinance and shut off the water, the attorneys would <br />request an injunction and a bond would have to be posted. <br />John Grayson, member of the Heritage Village Homeowners Board, <br />contended that the tenants did not ask for County utilities, nor <br />did the County mandate it, but that the mobile home park owner had, <br />in fact, requested County utilities. <br />Chairman Eggert pointed out that if that is true, the tenants <br />will win in Court and get their money back. <br />Mr. Grayson argued that the tenants do not have the money to <br />pay the bills. <br />Commissioner Macht asked how the park owner can say he does <br />not want the water, and Director Pinto clarified that the park <br />owner is saying he does not want to continue receiving water at his <br />expense. Director Pinto felt that if the tenants really think they <br />have a strong position, they can pay the water bill and deduct it <br />from the rent they pay the landlord. <br />Chairman Eggert closed the public discussion. <br />MOTION WAS MADE by Commissioner Bird, SECONDED by <br />Commissioner Tippin, to hold in abeyance the amount <br />owed to this date to County Utilities for water <br />service to Heritage Village Mobile Home Park <br />residents; that penalties and interest on that <br />amount would continue to accrue; that as of the next <br />billing period the County would ask both parties to <br />pay the amount of the utility bills, with one amount <br />to be deposited in the Court Registry until the <br />outcome of the lawsuit and with the other amount <br />going to the County Utilities Department to pay the <br />utility bill; and that any unpaid bills will be <br />handled individually according to procedure and <br />treated as any other utility customer who does not <br />pay a utility bill. <br />Under discussion, Commissioner Adams stressed that she did not <br />think this would solve anything, and that we are just telling the <br />tenants to put up or shut up. <br />20 <br />
