ASHER <br />BY: ASSISTANT DIRE OR OF UTILITY SERVICES <br />BOOK 88 pnud75 <br />SUBJECT: RESOLUTION AUTHORIZING THE DIRECTOR OF UTILITY <br />SERVICES TO EXECUTE LIENS FOR UNPAID UTILITY <br />SERVICES, TO RECORD THEM IN THE PUBLIC RECORDS, <br />AND TO RELEASE THEM WHEN PAID <br />BACKGROUND <br />Section 201.22 of the Code of Laws and Ordinances of Indian River <br />County authorizes the County to claim a lien against property owned <br />by customers of the County utility system for unpaid utility <br />services and to record the liens in the public records. <br />ANALYSIS <br />Claiming these liens and releasing them is a routine matter which <br />could be handled more efficiently by not bringing each lien before <br />the Board of County Commissioners. <br />RECOMMENDATION <br />The Department of Utility Services requests the Board of County <br />Commissioners' adoption of the attached resolution authorizing the <br />Director of Utility Services to execute and record claim of lien <br />forms for unpaid utility bills and to release them when paid, when <br />such forms and releases are also signed by the County Administrator <br />and the County Attorney. <br />ON MOTION by Commissioner Tippin, SECONDED by <br />Commissioner Macht, the Board unanimously adopted <br />Resolution 92-219 authorizing the Director of <br />Utility Services to execute liens for unpaid utility <br />services, to record them in the Public Records, and <br />to release them when paid, as recommended by staff. <br />6 <br />
