Director Davis responded that the County has this authority, <br />and the developer could set up a homeowners' association to pay the <br />monthly charge to the power company. However, it would be an <br />after -the fact homeowners' association and the developer would need <br />the unanimous approval of all the homeowners to set it up. <br />Attorney Vitunac suggested the County could set up an MSBU and <br />only charge the Whispering Pines residents. He added that the law <br />does not require everyone who gets the benefit of the lights to <br />help pay for them. <br />Director Davis mentioned that there are no installation <br />charges for the street lights, but an annual fee is charged which <br />covers the energy costs and also pro rates the cost of the fixture <br />over ten years. He would need to ask the power company about <br />having the developer pay for the poles and fixtures and the <br />residents pay the annual energy charges. <br />Commissioner Bird thought the County should require Mr. <br />Mitchell to install the lights and bill the energy costs*to just <br />the residents of Whispering Pines.
