Sharon Anderson, 9336 126th Avenue, Fellsmere, indicated that <br />she recently built her home 1-1/2 miles from the proposed plant and <br />plans to be there at least 30 years. Therefore, she is worried <br />about the long-term effect of these chemicals. <br />The Chairman closed the public discussion. <br />Commissioner Eggert felt that it is important for the FDER to <br />receive all of the information presented during this public <br />discussion. <br />Commissioner Adams agreed and thought the County should watch <br />closely how the FDER monitors this process. She did not think the <br />County has any other legal standing at this point. <br />MOTION WAS MADE by Commissioner Adams, SECONDED by <br />Commissioner Eggert to forward the information and <br />concerns presented during this public discussion to <br />the Orlando FDER office. <br />Under discussion, Commissioner Macht stated that monitoring <br />the process was one of the first things he thought about when he <br />saw the proposal. He asked if there is anything in law or anything <br />in procedure that would prevent the County government, on <br />reasonable suspicion of non-compliance, from notifying the FDER, <br />and if they are unwilling or unable to act in a timely manner, to <br />contract with a qualified expert to take an air sample and then <br />shut the plant down if it were found to be in non-compliance. <br />Attorney Vitunac advised that the FDER has not pre-empted the <br />field, and Chapter 403 specifically encourages local programs as <br />long as they are consistent with the FDER's program. The County <br />can develop a program and have it approved by the FDER. In <br />addition, Mike Gilanis of Environmental Control here in the Vero <br />Beach office can offer some expertise. Even though they do not <br />currently do air enforcement, if a program were developed, 'they <br />could probably insert it into their system. <br />Commistioner Adams recommended that the County could cover all <br />industries with such a program, and not just this one, and <br />Commissioner Eggert agreed. <br />Commissioner Macht thought the County should investigate what <br />authority it has in these matters and set up such a program, <br />because anything could happen, including problems with petroleum <br />distillates from various sources. <br />THE CHAIRMAN CALLED FOR THE QUESTION. <br />It was voted on and carried unanimously. <br />41 <br />�. ���� ROOK <br />J <br />
