The Board reviewed the following memo dated December 2, 1992: <br />TO: Board of County Commissioners <br />r � <br />FROM: Terrence P. O'Brien - Assistant County Attorney-lit <br />ttorneyt <br />DATE: December 2, 1992 <br />SUBJECT: PROPOSED ORDINANCE ENTITLED: <br />AN ORDINANCE OF INDIAN RIVER COUNTY, FLORIDA <br />MAKING AN EDITORIAL REMOVAL OF CHAPTER 4 1/2 <br />CABLE TELEVISION (1974 CODE) AND NOTING THAT IN <br />CHAPTER 211 CABLE TELEVISION (1990 CODE) . <br />A public hearing date of January 12, 1993 is suggested for the subject <br />ordinance. <br />Attorney Vitunac explained that this is just an editorial <br />transfer to the new Code without printing the entire Chapter, <br />because staff knows it is going to be rewritten when Congress <br />adopts the new rules in April. <br />Commissioner Macht mentioned that some representatives at the <br />American Association of Retired Persons (AARP) asked him to gather <br />information on the new Cable -TV rules and regulations and perhaps <br />determine what will happen when the new legislation is fully <br />implemented. In response to their request, Commissioner Macht put <br />together a packet of information and informed the AARP <br />representatives that he would ask the Commission to place this item <br />on the agenda for discussion. He thought perhaps the Chairman <br />could be authorized to write a letter to the local franchises (TCE <br />Cable and Falcon Cable) asking them to rescind their recent <br />increases, which were undoubtedly pushed through before the new <br />regulations take effect. He will be bringing this item to the <br />Board for discussion in the near future. <br />The Chairman opened the public hearing and asked if anyone <br />wished to b6 -heard in this matter. There being none, he closed the <br />public hearing.. <br />ON MOTION by Commissioner Eggert, SECONDED by <br />Commissioner Macht, the Board unanimously adopted <br />Ordinance 93-4, making an editorial removal of <br />Chapter 4-1/2 Cable Television (1974 Code). and <br />noting that in Chapter 211 Cable Television (1990 <br />code) <br />43 <br />LJA <br />_N 19BOOK S' FA JE 51 <br />
