r SAN 12 1993 <br />BOOK 88 F'a;E 5,5® <br />"Several residents indicated that the park owners were <br />demanding payment of impact fees at the time the living <br />unit was transferred to a new owner and would not issue <br />a park certificate of occupancy or a new lease agreement, <br />saying that this payment by the new owner was required by <br />the County." <br />MOTION WAS MADE by Commissioner Eggert, SECONDED by <br />Commissioner Adams to send the following -letter, <br />with the modification suggested by Mr. Pitiak, to <br />all mobile home park association presidents and <br />officials of any organized mobile home park <br />organizations. <br />BOARD OF COUNTY COMMISSIONERS <br />1840 25th Street, Vero Beach, Florida 32960 <br />Telephone: (407)567-8000 <br />January 12, 1993 <br />TO WHOM IT MAY CONCERNS <br />Res County policy on paying water and newer impact fees for <br />mobile home units connecting to County utilities <br />Dear Mobile Home Park Resident: <br />Suncom Telephone: 224-1011 <br />At a public hearing called by the County Commission recently to discuss <br />matters of public interest relating to the County utility system it became <br />evident that there is a misunderstanding of the County.policy concerning who <br />pays water and sewer impact fees on the connection of any mobile home unit to <br />the County utility system. <br />Several residents indicated that the park owners were demanding payment of <br />impact fees at the time a living unit was transferred to a new owner and <br />would not issue a park certificate of occupancy or a new lease agreement, <br />saying that this payment by the new owner was required by the County. <br />The County policy has consistently been to require paymentof the impact fees <br />from the park owner, since the park owner is the property owner. While the <br />numerous contracts between the County and mobile home park owners negotiated <br />over the last .20 years are not identical, a common term of many of the new <br />agreements is that at the time of sale of a home in a park the park owner <br />must pay the County the current impact fee. Whether the park owner could <br />pass that charge through to the new home owner has never been' determined by <br />the County Commission. That is subject to Chapter 723, Florida Statutes, and <br />is strictly a matter of law and contract between the pagk owner and the home <br />owner. <br />86 <br />
