Therefore, in accordance with the requirements of the Indian River <br />Lagoon Protection Act (Chapter 90-262, Laws of Florida), it will be necessary <br />to abandon this facility and connect to the regional centralized sewer system. <br />Should you have any further concerns, please contact Mr. Lee Miller or me at <br />(407) 894-7555. <br />Sincerely,' <br />-Christianne C. Ferraro, P.E. <br />Program Manager <br />Domestic Waste <br />Chairman Bird asked whether that letter is a mandate which <br />would leave the Commission with no option to grant the requested <br />extension for connection to the County wastewater system. <br />County Attorney Charles Vitunac advised that since the State <br />requires the connection, the County does not have the option to <br />grant an extension. Now it is a matter of which governmental <br />agency will force Countryside to connect: the County, through our <br />procedures, or the DER through their procedures. Attorney Vitunac <br />also reported that in a telephone conversation the previous Friday, <br />Mr. Lee Miller of DER told Director Pinto that DER will not issue <br />an operating permit for Countryside to continue their treatment <br />plant. Countryside must connect to a public wastewater treatment <br />system. Attorney Vitunac pointed out that there is no question of <br />impact fees. The issue of impact fees was settled in 1985 giving <br />Countryside 1O years to pay the impact fees, and several months <br />0V <br />
