I JAN 2s 1993 <br />TO: Board of County Commissioners <br />THROUGH: Jim Chandler, County Administrator <br />FROM: Doug Wright, Director <br />Emergency Services <br />DATE: January 13, 1993 <br />SUBJECT: Approval of Resolution Related to Animal <br />Control; Amending the Fees, Penalties and <br />Procedures Related to Enforcement of the <br />Animal Control Ordinance <br />BOOK 88 PAGt 654 -7 <br />It is respectfully requested that the information contained herein be <br />given formal consideration by the Board• of County Commissioners at <br />the next regular scheduled meeting. <br />DESCRIPTION AND CONDITIONS <br />The fees, penalties and procedures established in Resolution 92-74 <br />have been revised in two areas of the proposed resolution now before <br />the Board for consideration. <br />The first proposed change is in Section 2, subsection c, entitled <br />"Redemption Penalties in addition to Impoundment Fees," the first <br />offense has been changed to a non -fee basis or a waiver. This change <br />is predicated on a request by Animal Control and the Humane Society <br />in an effort to enhance our outreach programs to help educate pet <br />owners to be responsible for their pets. <br />The second proposed change is not really a change, but rather a <br />correction. When Resolution 92-74 was prepared, the redemption <br />penalty fee amount specified in Section 21 subsection c, was <br />incorrectly transcribed. These fee amounts were correctly stated in <br />Resolution 91-57 approved by the Board on May 7, 1991, and these are <br />the same amounts that are requested -for approval now by the Board. <br />The correct redemption penalty amounts should be $15.00 for the first <br />recognized offense; $30.00 for a second offense; and $60.00 for any <br />third or subsequent offense, rather than the incorrect amounts of <br />$30.00, $60.00, and $100.00 respectively. <br />ALTERNATIVES AND ANALYSIS <br />The Division of Animal Control and the Humane Society feel the change <br />proposed regarding the waiver for the first offense in terms of <br />redemption penalty charges will help to educate the pet owners to <br />maintain control of their pets and not allow them to roam at large. <br />It will allow for only an impoundment fee to be charged for first <br />offenders without an additional redemption penalty. It is felt that <br />charging both for first offenders would escalate the civil penalty to <br />the point that some citizens might not be financially able to <br />retrieve their pets from the Humane Society. <br />--- RECOMMENDATION <br />Staff recommends the Board of County Commissioners approve the <br />proposed Resolution which provides for a redemption penalty fee <br />waiver for first offenders and provides the correct amounts of <br />$15.00, $30.00, and $60.000, in terms of redemption penalties for <br />first, second and third or subsequent offenses, after an initial <br />waiver has been granted. <br />28 <br />a � � <br />
