She would like to see the dismissal not <br />prejudice his future employment with the County. <br />Attorney Vitunac advised that under normal conditions our <br />personnel forms ask if you have ever been terminated for drug use, <br />and that will become a fact if this termination is upheld. <br />Attorney Collins advised that they do not ask for that <br />information on personnel forms any more because the Americans with <br />Disabilities Act doesn't allow that type of question. Former drug <br />use is considered a disability. <br />Administrator Chandler asked what position the Board would <br />consider giving Mr. Hallquist if he was reinstated. <br />Commissioner Adams felt that would depend on the position he <br />applied for -- perhaps he might want to be Utilities Director. If <br />he seeks treatment for his problem, (and he has admitted that he <br />has a problem but he is not saying it is drug related, he is saying <br />it is something else) she doesn't feel he should be prejudiced down <br />the road for getting that problem solved. <br />Administrator Chandler stressed that is the position that <br />staff had taken all along, that if he had a problem and was willing <br />to seek help, then we would proceed with assisting him in that <br />matter. However, every step along the way he did not admit that he <br />had a problem nor that he would he seek help. <br />Commissioner Eggert asked if at any time Mr. Hallquist was <br />offered mental health treatment rather than drug treatment, and <br />Mrs. Callahan stated that over the three days she had talked to <br />Jon, the feeling she had was that he didn't need help in that he <br />understood his problem whether it was drugs or whatever. He said <br />that if he went to a psychiatrist, he only would upset the <br />psychiatrist. <br />Administrator Chandler stated that in the hearing he held, <br />part of the statements from Mr. Hallquist and his attorneys were <br />that Pat Callahan and Jack Price misunderstood what had been <br />related. So they went through that, and Mr. Hallquist indicated <br />among other things that he felt they misunderstood because he was <br />depressed recently about incidents with his family and children <br />down in Miami. Beyond that, there wasn't any extensive discussion <br />on depression, not to the extent we have had today. More <br />importantly, Mr. Hallquist's main point and that of his attorneys <br />was that he didn't use drugs and had not used drugs for a long <br />period of time. Later on he stated that he used drugs in the <br />summer, but even later he said that he had used drugs only at New <br />Year's Eve and in the summer. There was no strong emphasis on <br />depression other than he felt that Mrs. Callahan and Mr. Price had <br />misunderstood and that he was depressed about a family incident in <br />32 <br />
