some period of time and then if he comes back to the County, and if <br />he has received help, the County would employee him in a vacant <br />position for which he is qualified. Administrator Chandler felt <br />that keeps the gap in terms of terminating and then rehiring. <br />Attorney Vitunac understood then that the Board would find <br />that he did commit the infraction for which termination normally <br />would be proper, but would find that too severe and would impose <br />some other penalties such as suspension from September until a <br />certain time, and at that time he would have to show that he is <br />rehabilitated from whatever his problem was. <br />Commissioner Adams felt that would set a real bad precedent <br />because he was given the option to resign or seek treatment to <br />begin with, and he never took that option. He has proceeded with <br />the appeal. We are saying to him to take care of his problem, <br />whatever it is. If we give this gap treatment, we would have to <br />let everybody else do the same thing whether it is severe drug <br />abuse or whatever. She stressed that we are giving him the benefit <br />of the doubt by saying that we are not going to prejudice him in <br />future applications with the County. She felt that we do need to <br />say that we do not condone what has been going on. <br />ON MOTION by Commissioner Adams, SECONDED by <br />Commissioner Eggert, the Board unanimously (4-0, <br />Commissioner Tippin being absent) upheld the <br />termination of employment of Jon Hallquist based on <br />the finding of fact that he did engage in conduct on <br />or off the job which tended to affect his <br />relationship to the job, fellow employees and the <br />reputation and goodwill in the community; and <br />declared that if he determines what his problem is <br />and seeks treatment for it, the County would <br />withhold any prejudice on any future applications <br />with the County (which is not to say that he will be <br />rehired, but just that we won't prejudice his <br />application if he comes back in with something he <br />would like to apply for). <br />Mr. Hallquist asked if that meant he could apply for any other <br />job other than a lifeguard, and Chairman Bird explained that he <br />could apply for a lifeguard position as well. <br />Mr. Hallquist asked if that would wipe out his tenure, and it <br />was explained that if he was rehired by the County, he would not <br />lose his 9-3/4 years tenure. <br />35 <br />FES 31993 BOOK : 88 PAGE 767 <br />
