Release of Indemnification Agreements - 14th Street <br />The Board reviewed memo from Deputy County Attorney William G. <br />Collins II dated February 4, 1993: <br />TO: The Board of County Commissioners <br />FROM: ' J(, William G. Collins II - Deputy County Attorney <br />DATE: February 4, 1993 <br />SUBJECT: Release of Indemnification Agreements - 1114th Street" <br />In 1984 the County received an indemnification agreement from the <br />Ekonomous as developers of property to the north of 14th Street. <br />Subsequently the Council on Aging executed a similar indemnification <br />agreement to the County in 1988. The purpose of the agreements was to <br />indemnify the County in the event that the County was named as a party to <br />a trespass suit by virtue of approving site plans for property which would <br />utilize "14th Street" to access U.S. 1 between the old Clock Restaurant and <br />the Home & Patio Shop. In fact, that strip of property was owned by Grace <br />LaCava. <br />Indian River County has purchased a 35' by 300' strip of right-of-way from <br />the Estate of Grace LaCava, and more recently obtained an additional 25' by <br />210' strip from Southgate Mobile Home Park. <br />Now that all the "right-of-way" is in County hands, there is no need for <br />continuation of the indemnification agreements. <br />RECOMMENDATION: <br />Authorize the County Administrator to execute Releases for delivery to the <br />Council on Aging, the Ekonomous and their successor Dorothy Faber, <br />Trustee. <br />ON MOTION by Commissioner Eggert, SECONDED by <br />Commissioner Macht, the Board unanimously approved <br />Releases of Agreement with Christopher Ekonomou, <br />Kathryn Ekonomou and Michael Ekonomou and with the <br />Indian River County Council on Aging, Inc., as <br />recommended by staff. <br />SAID RELEASES OF AGREEMENTS <br />ARE RECORDED IN THE PUBLIC RECORDS OF INDIAN RIVER COUNTY <br />H. Resignation of Dorothy A. Hudson from the Board of Zoning <br />Adjustment <br />ON MOTION by Commissioner Eggert, SECONDED by <br />Commissioner Macht, the Board unanimously accepted, <br />with regret, the resignation of Dorothy A.
