FEB 23 1993 <br />BOOK 88 F�1GE 9117 <br />Commissioner Macht understood there is no possibility this <br />site could be used for a refugee center under the existing zoning, <br />but asked if there is some mechanism to insure that no additional <br />requests for modular units on this site will be honored. <br />Director Keating advised that the church could come in and <br />request a special exception approval to expand further. We don't <br />have a limit on the amount of development that can occur, but the <br />County Commission would have to grant a special exception use <br />approval for any additional units. <br />Commissioner Adams pointed out that we are beginning to see a <br />proliferation of these types of structures and she felt neighbors <br />have a real stake in keeping the integrity of a single-family <br />residential area. Fortunately, 'this facility sits well off the <br />road and is not too noticeable unless you actually turn in off the <br />road. Ample buffering will help also. However, she wished to find <br />a way of putting the brakes to modular units or decide whether or <br />not we are going to allow them all over. <br />Chairman Bird asked if we could impose some kind of time limit <br />for these modular units to be replaced with permanent fixtures, but <br />Attorney Vitunac advised that the law has taken that right away <br />from the Board. These modular units have to be treated as legal <br />buildings and the Building Code issue. was taken away from us by the <br />Legislature. The issue is the land use. If the structures are put <br />in a proper place according to our site plan regulations, the Board <br />reduced to making a decision on the one item of a special exception <br />and the question of whether this is the type of use which is <br />appropriate if controlled as to numbers in the area. He believed <br />that staff has recommended that this is the type of use that is <br />okay. <br />Director Keating explained- the difference in regulations <br />between mobile homes and modular units, and Director Boling further <br />described the requirements for modular units. <br />Commissioner Macht asked if we could include language in the <br />Motion to approve this with a limitation on the numbers, and <br />Attorney Vitunac advised that the Commission cannot do that under <br />our Code. <br />Commissioner Adams stated that she would vote for approval <br />with reluctance. <br />ON MOTION by Commissioner Tippin, SECONDED by <br />Commissioner Eggert, the Board unanimously granted <br />special exception use approval to Riverside Church <br />Assembly of God -for an expansion to a place of <br />worship. <br />34 <br />
