McCoy, AICP dqA <br />Senior Planner, Current Development <br />DATE: March 4, 1993 <br />SUBJECT: Jeffrey & Lisa Abernethy's Request to Abandon the North <br />10' of 10th Street'Right-of-Way Between 22nd Avenue and <br />24th Avenue <br />It is requested that the data herein presented be given formal <br />consideration by the Board of County Commissioners at its regular <br />meeting of March 16, 1993. <br />DESCRIPTION AND CONDITIONS: <br />Robin Lloyd, esquire, has submitted a petition on behalf of Jeffrey <br />and Lisa Abernethy (owners) to abandon the north 10' of a segment <br />of 10th Street right-of-way located between 22nd Avenue and 24th <br />Avenue. Per guidelines established by the Board of County <br />Commissioners, the petition was reviewed by all county divisions <br />and utility providers having jurisdiction within the right-of-way. <br />All reviewing agencies have recommended approval of the <br />abandonment, with the provision that a drainage and utility <br />easement be retained over the 10' strip. Although the county would <br />retain an easement, the property owners would still benefit since <br />the abandoned right-of-way/easement can be used as setback area. <br />The owners' stated purpose for seeking this abandonment is to cure <br />an existing setback encroachment. Approval of the abandonment <br />request would resolve the setback encroachment. <br />ANALYSIS: <br />This portion of 10th Street is not part of the roadway system as <br />noted on the county Thoroughfare Plan, and is not needed for the <br />thoroughfare plan system. No road has been constructed in the <br />right-of-way; however, a portion of the overall right-of-way has <br />been cleared, and utilities and drainage improvements have been <br />constructed. The staff has determined that the portion of the <br />proposed segment of right-of-way to be abandoned -is not needed for <br />future neighborhood traffic circulation, nor for convenient access <br />to any private property. Furthermore, approval of the request <br />(along with the retained easement) will not affect utility <br />services. <br />20 <br />
