Bill Sherry, airport director of the City of Vero Beach, <br />understood the County's position but was concerned about removing <br />the overflight zone. He felt that although the proposed ordinance <br />meets the minimum standards of Florida Statute 333, it falls short <br />of Department of Transportation (DOT) recommendations. He was <br />fearful that public safety was being compromised. <br />Evelyn Neville, owner of the property on the north side of SR - <br />60 across from the airport, asked whether her property will be <br />affected by the ordinance. <br />Director Boling responded that some of Ms. Neville's property <br />is in the runway clear zone area. Her property line is about 700 <br />to 800 feet away from the runway. If she wanted to build a <br />structure in the middle of her property, the FAA would have to be <br />notified of its location and proposed height and the FAA would then <br />determine whether the building would be a hazard. <br />Mrs. Neville asked whether the FAA will be considerate in <br />their judgment about what she can or cannot do. <br />Director Boling pointed out that the height notification <br />requirements are a much lower slope than the actual standards the <br />FAA uses. As long as the height of the building does not exceed <br />the actual standards, the FAA should come back with a no hazard <br />ruling. <br />Commissioner Eggert pointed out that even if we did not pass <br />this ordinance, the federal requirements would still be in place. <br />It was determined that no one else wished to be heard on this <br />proposed ordinance and the Chairman closed the public hearing. <br />ON MOTION by Commissioner Eggert, SECONDED by <br />Commissioner Macht, the Board unanimously (4-0, <br />Commissioner Tippin being absent) adopted Ordinance <br />93-7, amending Chapters 901 and 911 of the Land <br />Development Regulations and providing for repeal of <br />conflicting provisions, codification, severability <br />and effective date; and establishing section 911.17, <br />Airport Zoning. <br />_ F INTERLOCAL AGREEMENT <br />IS ON FILE IN THE OFFICE OF CLERK TO THE BOARD <br />7 <br />LtIAR 181993 <br />BOOK 89 FACE 58 <br />
