Xeati g, C7-- <br />THRU: Sasan Rohani <br />Chief, Lonpj,,, <br />Planning <br />FROM: John Wacht <br />Staff Planng-Range Planning <br />DATE: March 22, 1993 <br />RE: COUNTY INITIATED REQUEST TO ADMINISTRATIVELY REZONE <br />APPROXIMATELY 10.81 ACRES FROM RS -6 TO RM -10 <br />(RZON 92-12-0057) <br />It is requested that the data herein presented be given formal <br />consideration by the Board of County Commissioners at their regular <br />meeting of April 6, 1993. <br />DESCRIPTION AND CONDITIONS <br />This is a request to rezone approximately 10.81 acres. Located on <br />the north side of 47th Street, between 38th Court and 35th Avenue, <br />the subject property consists of six parcels, each separately <br />owned. The owners are Theola Perry, Barris and Georgia Reddie, <br />Herbert W. Morris, Clarence L. and Dora Mae Flemming, Anne Lee <br />Lane, and Indian River County. <br />The request involves rezoning the property from RS -6, Single -Family <br />Residential District (up to 6 units/acre) to RM -10, Multiple -Family <br />Residential District (up to 10 'units/acre). This request is <br />related to a recent rezoning action affecting adjacent property. <br />In August of 1992, the Indian River County Housing Authority <br />(IRCHA) requested that the parcel depicted on Attachment 3 and <br />located north and west of the subject property be rezoned from RS -6 <br />to RM -10. As shown, this property has an unusual configuration. <br />Because of this configuration, staff determined that additional <br />Property should be rezoned along with the IRCHA tract to produce a <br />squared -off zoning boundary. For that reason, staff, while <br />processing the IRCHA rezoning, attempted to contact adjacent <br />property owners to determine if those owners would consent to join <br />in the rezoning to produce a squared -off tract that could be zoned <br />RM -10. <br />In so doing, county planning staff contacted the property owners of <br />parcels 1 through 8 and parcel 10 (shown on Attachment 4) to <br />determine if those owners would object to their parcels being <br />rezoned to RM -10. Of the nine owners, six (parcels 1-5, and 10) <br />expressed no objection to having their property rezoned; two owners <br />(parcels 6 and 8) did express objection, while the owner of parcel <br />36 <br />
