BOOK <br />ON MOTION by Commissioner Adams, SECONDED by <br />Commissioner Macht, the Board unanimously scheduled <br />a public hearing at 7:00 P.M. on April 27, 1993 at <br />the Fellsmere Elementary School cafeteria. <br />PURCHASE AUTHORIZATION - 45TH STREET RIGHT -OF -NAY ACQUISITION <br />GRACE WALKER PARCELS <br />The Board reviewed the following memo dated March 19, 1993: <br />TO: James E. Chandler <br />County Administrator <br />THROUGH: James W. Davis, P.E. <br />Public Works Director <br />and <br />Terry B. Thompson, P.E. <br />Capital Projects <br />�P J Manager <br />FROM: Donald G. Finney, SRA• <br />County Right of Way Agent <br />SUBJECT: Purchase Authorization; 45th Street Right -of -Way Acquisition, Grace Walker <br />Parcels <br />DATE: March 19, 1993 <br />Indian River County is proceeding to construct Indian River Boulevard, Phase 4, from 37th Street <br />to 53rd Street. The additional right-of-way needed to accomplish this project consists of these two <br />parcels at the intersection of the Boulevard and 45th Street. A Contract For Sale and Purchase was <br />sent to the property owner at the appraised value of each .07 acre parcel. The property owner has <br />not agreed to sell at the $2,961 appraised value for each parcel but originally requested <br />compensation in the amount of $25,000. Staff has communicated with the property owner and his <br />attorney that values in the area do not justify this cost, and the property owner has executed a <br />Contract For Sale and Purchase at the purchase price of $4,900 each for a total of $9,800. The <br />contract also specifies payment of $50.00 for each producing citrus tree which will have to be <br />removed, and the number of trees is to be determined during construction. Approximately 30 trees <br />are within a temporary construction easement that is also necessary to construct the Boulevard <br />project. Mr. Roddenberry's attorney fee is $650, which is also a part of this contract. <br />RECOMMEMATION <br />Staff requests the Board accept the $9,800 contract, tree costs of approximately $1,500, and attorney <br />- fee of $650, and direct the chairman to execute the contract on the Board's behalf. In addition to the <br />right-of-way area being acquired, the land owner has executed a temporary construction easement <br />included in this settlement. <br />84 <br />
