DeBlois,-AICP <br />Chief, Environmental Planning <br />DATE: April 6, 1993 <br />BOOK 89 PAGE 3,9 -1 <br />RE: Use of Wetland Mitigation Bank Funds <br />for Environmental Learning Center Wetland Restoration <br />It is requested that the data herein presented be given formal <br />consideration by the Board of County Commissioners at their regular <br />meeting of April 13, 1993. <br />DESCRIPTION AND CONDITIONS <br />Section 928.06(5) of the County Wetlands Protection Ordinance <br />provides that the county may accept fees as a last alternative for <br />wetland dredge and fill mitigation associated with development. The <br />mitigation fee -is calculated as [the assessed value of one acre of <br />the project site] x [the number of wetland acres impacted]. <br />Section 928.06(5) further provides that such funds are deposited in <br />a "mitigation bank" account which will be utilized "to create, <br />protect and manage, or enhance environmentally sensitive areas of <br />the same type as that altered". <br />The mitigation bank fund concept has been in effect since September <br />1990, when the county's land development regulations were <br />substantially revised to implement the goals, objectives, and <br />policies of the 1990 comprehensive plan. Since that time, $8,670 <br />has been either paid, or committed for payment, into the wetland <br />mitigation fund (Account # 601-000-220-018.00). <br />Staff requests that the Board of County Commissioners consider <br />authorizing the use of. $2,600 of these funds for wetland <br />restoration work at the Environmental Learning Center (ELC). The <br />ELC site is county owned land, under a long-term lease to the ELC. <br />ALTERNATIVES & ANALYSIS <br />Three wetland mitigation projects involving activities at the ELC <br />site have been authorized by state and federal wetland <br />jurisdictional agencies, as well as by county environmental <br />planning.staff. Specifically, wetland filling that was permitted <br />on three single-family lots in Ambersand Beach Subdivision on north <br />S.R. AlA was conditioned upon off-site mitigation at the ELC. <br />The mitigation of these projects <br />preparation of the area proposed for <br />preparation consists of minor grading <br />for wetland plantings, -and the removal <br />36 <br />has been delayed pending <br />restoration.
