r <br />MAY I 1093 <br />TO: B rd of County ommissioners <br />FROM: Charles P. -Miunty Attorney <br />DATE: May 7, 1993 <br />RE: EXPANSION OF THE COUNTY SEAT <br />BOOK 89 PnE, 503 <br />Section 30.10, Florida Statutes, requires that the place of office of <br />every County Officer shall be at the county seat, which in Indian River <br />County is the City of Vero Beach. The Sheriff's Office is located in <br />the unincorporated area of the County contiguous to the City of Vero <br />Beach and, as far as our research can document, the county seat has <br />never been expanded to include this property. <br />The Sheriff's Office may be brought into the county seat by annexation <br />of the land into the City or by expansion of the county seat <br />boundaries. The easier method is the expansion of the county seat <br />boundary. The Commissioners may expand the county seat boundaries <br />pursuant to Section 138.12, Florida Statutes which requires the adoption <br />of a resolution after the board has held at least two public hearings at <br />intervals of not less than 10 days nor more than 20 days and after <br />notice of the proposal and such meetings have been published in a <br />newspaper of general circulation. Public Hearings have already been <br />held on April 6, and April 27, 1993. No member of the public spoke. <br />Recommendation: <br />Staff recommends, after the public hearing on May 11, 1993, that the <br />attached resolution be adopted expanding the County seat to include the <br />Sheriff's Office and Jail. <br />The Chairman opened the public hearing and asked if anyone <br />wished to be heard in this matter. There being none, he closed the <br />public hearing. <br />ON MOTION by Commissioner Adams, SECONDED by <br />Commissioner Tippin, the Board unanimously adopted <br />Resolution 93-89, expanding the boundaries of the <br />County seat to encompass the location of the <br />Sheriff's office and_ jail. <br />38 <br />
