Agreement for Construction of Golf Course Tunnel Beneath Indian <br />River Boulevard <br />The Board reviewed the following memo dated 5/11/93: <br />TO: Board of County Commissioners <br />FROM: James W. Davis, Director of Public Works ' <br />Terrence P. O'Brien, Assistant County AttorneyC' <br />DATE: May 119 1993 <br />RE: AGREEMENT FOR CONSTRUCTION OF <br />GOLF COURSE TUNNEL BENEATH INDIAN RIVER <br />BOULEVARD <br />In connection with the subject agreement, a license was issued to Grand <br />Harbor to utilize a portion of County right-of-way under Indian River <br />Boulevard. The license was drafted so that it could only be assigned <br />with the County's written permission. The lending institution for <br />Grand Harbor would like further assurances of assignability in the <br />event of foreclosure. A draft letter has been prepared by the Attorney <br />for Grand Harbor which, if executed by the County, would provide the <br />lending institution with the further assurances that it seeks. <br />RECONIlMMATION: It is recommended that the Commission authorize <br />the Chairman to execute the attached letter on behalf of the <br />Commission. <br />ON MOTION by Commissioner Eggert, SECONDED by <br />Commissioner Tippin, the Board unanimously approved <br />a letter of assurances of assignability, as <br />recommended by staff. <br />14 <br />
