M - M <br />(8) Status of decisions. Actions taken by the <br />board of county commissioners regarding the <br />granting of special exceptions along with any ap- <br />propriate conditions and safeguards shall be <br />deemed final unless an appeal is filed pursuant to <br />the procedures of Chapter 902. <br />(9) General criteria for review of special excep- <br />tion uses. Prior to approval by the board of county <br />commissioners, a special exception use applicant <br />must present evidence of compliance with the <br />below cited general criteria as well as spec cri- <br />teria for the respective special exception use cited <br />herein in Chapter 971, regulations for specific land <br />uses. The applicant shall have the burden of es- <br />tablishing, by competent material and substan- <br />tial evidence, the existence of the facts and con- <br />ditions which this chapter requires for approval. <br />The applicant shall have the responsibility to <br />present evidence in the form of testimony, ex- <br />hibits, documents, models, plans and the like to <br />support the application for approval of a special <br />exception use. <br />(a) Consistency with comprehensive plan and <br />zoning code. The proposed use shall be con- <br />sistent with the comprehensive plan and <br />with the stated purpose and intent of the <br />appropriate district regulations and all ap- <br />plicable regulations within this chapter. <br />(b) Compatibility with surrounding land uses. <br />The proposed use and its location shall be <br />compatible with surrounding land uses and <br />the general character of the area, based on <br />consideration of such potential impacts as <br />traffic generation, drainage, nuisance im- <br />pacts, lighting, appearance, and other fac- <br />tors potentially impacting the character and <br />stability of the surrounding area. <br />(d) Promote orderly development. The use and <br />proposed location shall promote orderly and <br />efficient development considering such fac- <br />tors as impact on public facilities, preser- <br />vation of neighborhood integrity, and sim- <br />ilar factors impacting orderly development <br />of the area <br />(10) Specific criteria for review of special excep- <br />tion uses. In addition to satisfying the general cri- <br />teria for reviewing special exception uses as es- <br />tablished herein, a special exception use must also <br />be found to satisfy the specific criteria for the par- <br />ticular land use, as established in this chapter. <br />(Ord. No. 90-16, § 1, 9-11-90; Ord. No. 91-7, § 23, <br />2-27-91; Ord. No. 9148, § 85, 12-4-91) <br />(c) No adverse impacts on public health, safety, <br />and general welfare. The proposed use and <br />its location and method of operation shall <br />promote the public health, safety, and gen- <br />eral welfare. The proposal shall include any <br />landscape and structural improvements, <br />public facility expansions, and operational <br />restrictions or procedures required to effec- <br />tively mitigate potential negative impacts <br />of the use. <br />44 <br />MAY 18 1993 800K 89 fAvE 585 <br />
