Attorney Barkett used the aerial enlargement and described the <br />subject property and its relationship with surrounding properties. <br />Mr. Barkett felt that staff gave a good history of the project, but <br />pointed out that Trevor Smith originally requested heavy commercial <br />zoning rather than limited commercial. At that time the Board <br />agreed that his property is not useful as residential property and <br />that he should be given some relief but they agreed that C/L would <br />be intense. The Board also commented that Trevor Smith's property <br />was small, it would be almost like spot zoning, and he should <br />reapply with the whole block. Trevor Smith joined all the property <br />owners on Old Dixie Highway from 8th Street to 9th Street because <br />they feel that 8th Street is the logical place to terminate the C/L <br />zoning. Mr. Barkett argued that there is a need for C/L zoning. <br />Any additional traffic that the property generates will be handled <br />by the programmed expansion of Old Dixie Highway and will be <br />addressed in the site plan stage. The lighting situation would be <br />mitigated by the vegetative buffering, which is twice as dense in <br />C/L as in OCR. Mr. Barkett conceded that the neighbors were <br />worried about a 7 -Eleven type store on that property. While he <br />could not say that would not happen, he thought it unlikely because <br />there is a convenience store at 12th Street and Old Dixie Highway. <br />He expected that with rezoning to C/L, the property would be <br />developed into a strip of stores and offices much like Colonial <br />Plaza. He listed the types of businesses that could be included in <br />that type of zoning and he requested that the Board rezone this <br />property to C/L, Limited Commercial. <br />Karl Brubaker, 835 10th Avenue, was opposed to the rezoning. <br />He stated that he has appeared before the Board previously and the <br />situation has not changed since that time except that other <br />property owners have joined with Trevor Smith in his request for <br />rezoning. Rezoning would adversely affect the residential <br />neighborhood which has been there for 45 years. He pointed out <br />that three new homes were built recently in that neighborhood. <br />Trevor Smith's property abuts the residential property and is very <br />close to the bedroom of the nearest home. Mr. Brubaker stated that <br />the property was zoned residential when Trevor Smith and the others <br />bought their properties.. He pointed out that Mrs. Watson's <br />property, which is closest to Mr. Wood's property on 8th Street, <br />will have commercial zoning on two sides of her home. This is not <br />something that is blank space; this is a neighborhood that has been <br />in existence for 45 years. No one wants a 24-hour establishment <br />like a 7 -Eleven or a clinic beside their home. He felt that the <br />property owners who are asking for the rezoning have given up on <br />31 <br />BOOK 89 R+,r 6,3? <br />
