Survey <br />findings are as follows. <br />Jurisdiction Regulations <br />Indian River County Allowed in heavy commercial and <br />light industrialzoning districts by <br />conditional use and site plan <br />approval. <br />Vero Beach Prohibited. Sales activity required <br />to be "under roof". <br />Sebastian <br />Prohibited. Indoor flea markets <br />allowed only by conditional use <br />approval. <br />St. Lucie County <br />Prohibited. Sales activity required <br />to be in enclosed buildings. <br />Martin County <br />Allowed in general commercial <br />district by conditional use and site <br />plan approval. <br />Brevard County <br />Allowed in general retail commercial <br />zoning district by site plan <br />approval. <br />Orange County <br />Allowed as conditional use in <br />general commercial district, <br />permitted use in heavy commercial <br />district; site plan approval <br />required. <br />Manatee County Allowed in commercial and industrial <br />districts by conditional use and <br />site plan approval. More <br />restrictions in commercial <br />districts. More restrictions for <br />open-air facilities. <br />Sarasota County Allowed in intensive commercial <br />district by site plan approval. <br />None of the local governments surveyed allow flea markets by <br />issuance of temporary use permits; all require site plan approval <br />where flea markets are allowed. <br />Based on these f indings . staf f I s conclusion is that Indian River <br />County's existing flea market regulations are consistent with other <br />jurisdictions that allow flea ma kets. Furthermore, allowing flea <br />markets to be established via a temporary use permit would appear <br />to make Indian River County the least restrictive local government <br />in the region in regards to flea market regulations. <br />eStaff Concerns <br />In regards to the Wabasso flea market issue, staff's main concern <br />is that changing the LDRs to allow a Wabasso flea market type of <br />use via a temporary use permit will effectively loosen current <br />restrictions for - open-air flea markets in general. Such a <br />loosening of restrictions will allow flea market uses in more areas <br />14 <br />
