Geoffrey subdivision,, the subject property has <br />historically been used for residential development. The completion <br />Of U.S. #1 and Old Dixie Highwayl howevers separated the subject <br />property from the rest of the subdivision. This "carving out" of <br />the subject property created an areal between U.S. #1 and Old Dixie <br />Highwayf that is appropriate for commercial development. <br />Generally,, the existing CG zoning is appropriate for the subject <br />property. In circum tances such as that of the subject propertyl <br />it is assumed that non -conforming residences will eventually <br />convert to commercial uses. With respect to the subject propertyp <br />the adjacent roadways provide convenient access and are considered <br />assets to the retail uses for which the CG zoning district is <br />intended. <br />However, in this case, the OCR zoning district is also appropriate. <br />The OCR zoning district allows both commercial uses to develop and <br />existing residential uses to continue. Furthermorel the OCR zoning <br />district is compatible with the residential areas east of the <br />subject property, as well as commercial uses north of the subject <br />property. For these reasonst the OCR zoning district is <br />appropriate for the subject property. <br />Conclusion <br />The requested zoning is compatible with the surrounding areal <br />consistent with the goalso objectives, and policies of the <br />comprehensive planl and meets all applicable concurrency criteria. <br />The subject property is located in an area deemed suitable for a <br />mix of office, restricted commerciall and residential uses. The <br />request meets all applicable criteria. Staff supports the request - <br />Recommendation <br />Both staff and the Planning and Zoning Commission recommend that <br />the Board of County Commissioners approve this request to rezone <br />the subject property from CG to OCR. <br />The Chairman opened the public hearing and asked if anyone <br />wished to be heard in this matter. There being none, he closed the <br />public hearing. <br />ON MOTION by Commissioner Eggert, SECONDED by <br />Commissioner Adams, the Board unanimously (4-0, <br />Chairman Bird being absent) adopted Ordinance 93-25, <br />amending the zoning ordinance and the accompanying <br />zoning map from CG to OCR, for the property <br />generally located at the southwest corner of U.S. #1 <br />and 39th Street, as recommended by staff. <br />24 <br />
