RECOMMENDATION <br />The staff of the Department Of Utility Services recommends that the <br />Board of County Commissioners approve Change Order 2 and authorize a <br />reduction of retainage to 5'percent. <br />ON MOTION by Commissioner Eggert, SECONDED by <br />Commissioner Macht, the Board unanimously (4-0, <br />Chairman Bird being absent) approved Change Order 2 <br />with Boyce Company and authorized reduction of <br />retainage to 5 percent, as recommended by staff. <br />CHANGE ORDER IS ON FILE <br />IN THE OFFICE OF THE CLERK TO THE BOARD <br />REQUEST FOR AN ORDINANCE PROHIBITING THE INTRUSION OF LIGHT ON <br />ADJACENT RESIDENTIAL PROPERTY <br />Assistant County Attorney Terry O'Brien presented the <br />following memo dated June 2, 1993 and letter from Mr. Herbert L. <br />Osborn dated May 24, 1993: <br />TO: Board of County Commissioners <br />lvp <br />FROM: Terrence P. O'Brien - Assistant County Attorney " 0 <br />DATE: June 2. 1993 <br />SUBJECT: REQUEST FOR AN ORDINANCE PROHIBITING THE <br />INTRUSION OF LIGHT ON ADJACENT RESIDENTIAL <br />PROPERTY <br />I recently received a phone call and a letter from a Mr. Osborn (copy <br />attached) concerning a halogen security light which his neighbor has <br />installed that shines directly on to his house. Mr. Orsborn has <br />requested that the County consider an ordinance which would prohibit <br />the unwanted Intrusion of high intensity lighting on adjacent residential <br />property. <br />Such an ordinance would be within the ambit of County police powers. <br />Accordingly, staff requests direction from the Commission as to whether <br />staff should prepare a draft ordinance for Commi sion consideration. <br />51 <br />BOOK 89 FA.u.850 <br />
