BROOKS, MANAGER <br />SOLID WASTE DISPOSAL DISTRICT <br />SUBJECT: <br />GRANTS PROGRAMS <br />BACKGROUND <br />The Florida Department of Environmental Protection (DEP) provides <br />grants to the Florida counties for various solid waste management <br />programs. The recycling and education grants have been extremely <br />beneficial and require a joint agreement between the county and <br />the municipalities therein to obtain full benefit of the grants. <br />The DEP's recycling grant program is more specifically provided <br />to the counties and where a separate entity of the county, such <br />as the Solid Waste Disposal District, is responsible for the <br />utilization of a grant a legal technicality lies in the <br />procedural management of the grant. <br />In spite of the clear delegation of solid waste management to the <br />Solid Waste Disposal District the DEP has expressed concern as to <br />the SWDD's being legally able -to coordinate, manage, and utilize <br />grant funds. To alleviate their concerns they have indicated <br />that the county by Resolution should delegate the authority to <br />the SWDD to apply for grants, enter in agreements for grants, and <br />utilize grant funds. <br />CONCLUSION <br />Attached for execution by the Board of County Commissioners is a <br />Resolution which will hopefully provide the legal document needed <br />by the DEP or any other agency to clearly identify the y <br />authorization of the SWDD to apply for and utilize grant funds <br />for any aspect of solid waste management. <br />ON MOTION by Commissioner Eggert, SECONDED by <br />Commissioner Tippin, the Board unanimously adopted <br />Resolution 93-134, authorizing the Solid Waste <br />Disposal District to apply for and utilize any and <br />all grants available to the County for waste oil <br />collection and recycling, etc., as set out in <br />staff's recommendation. <br />R <br />
