� r � <br />RECOMMENDATION: <br />Based on the analysis performed, staff recommends that the Board of <br />County Commissioners approve the special exception use with the <br />following conditions: <br />1. That the applicant revise the proposed site plan to eliminate <br />the driveway onto 12th Street. <br />2. That prior to the issuance of a C.O. for the project, the <br />applicant shall have constructed a sidewalk along the site's <br />7th Court frontage. <br />3. That prior to site plan release, the applicant shall execute <br />and record a unity of title for the project. <br />Public Works Director Jim Davis advised that the purpose of <br />Section 952.12 of our Code is to protect the integrity of arterial <br />roads. He indicated that 12th Street is one of the few 5 -lane <br />roads in the County and should be protected from vehicles slowing <br />down to make turning movements. He explained that the waiver <br />clause in the Code was written to accommodate large commercial <br />facilities where multiple driveways would be justified, but the <br />subject parcel is small and does not warrant having more than one <br />driveway. He recommended that the driveway be constructed off 7th <br />Court, which is a local access road. <br />Commissioner Eggert led discussion concerning the possibility <br />of allowing only eastbound ingress and egress. <br />The Chairman opened the public hearing and asked if anyone <br />wished to be heard in this matter. <br />John Hill, project engineer representing Mark Mosshart, <br />distributed photographs of the subject site. He pointed out that <br />there was a driveway onto 12th Street when Mr. Mosshart purchased <br />the property. He felt that the driveway would have a very minimal <br />impact on traffic flow, but not having it would severely hurt Mr. <br />Mosshart's business. <br />Mark Mosshart, 303 Old Dixie Highway, reported that his <br />business is currently on the corner of 3rd Place and Old Dixie <br />Highway. His current location does not have direct access onto Old <br />Dixie Highway which in his opinion has hurt his business. He was <br />convinced that many people who buy automobiles drive by a <br />dealership, see a car, and buy on impulse. If they are unable to <br />enter the property easily, they will not stop.
