AUG 24 199' BOOK 90 FAGE319 <br />ANALYSIS <br />Under the Agreement, the County provides wastewater treatment for <br />the City to be billed under the County bulk rate agreed to in the <br />Agreement. The County, at the request of the City, provides no <br />water service. <br />The City has requested, by the attached letter, "County <br />Commission approval for 70 ERUs of wastewater capacity in the <br />North Indian River County Wastewater Treatment Plant to be <br />purchased for the Sebastian Lakes development. This request is <br />understood to be only for the assurance that Sebastian Lakes will <br />receive County permission to allow connection to the County's <br />wastewater system in the future. It is further understood that <br />there will be no guarantee that the 70 ERUs will be reserved at <br />the plant for Sebastian'Lakes until such time as the impact fees <br />are paid in full to Indian River County." <br />County policy is to reserve and commit capacity only upon receipt <br />of payment of impact fees. The Department would agree to the <br />request for. 70 ERUs of capacity for Sebastian Lakes upon payment <br />of the required impact fees. Because the County revised its <br />master plan, removing the City from its water and wastewater <br />service area at the City's request, the Department would request <br />that before additional capacity is committed, the City analyze <br />its total requirements for capacity that it cannot serve and <br />submit a request for those requirements. The request would <br />require a revision of the Utility Master Plan and the City would <br />be required to pay for the revision. <br />RECOMMENDATION <br />The Department of Utility Services recommends commitment of the <br />70 ERUs of requested capacity upon payment of impact fees and, if <br />the City has decided that they cannot provide capacity as first <br />indicated and requests the County to provide the capacity, the <br />County must revise its Utility Master Plan to include the City <br />capacity at the City's expense. <br />Utility Services Director Terry Pinto advised that the City of <br />Sebastian previously asked to be eliminated from the Utilities <br />Master Plan. He probably would have recommended against providing <br />service to Sebastian Lakes, but this particular project was in <br />existence when the original Utilities Master Plan was developed, <br />and we can accommodate them without any major changes to the <br />system. Therefore, Director Pinto recommended approving the <br />allotment of 70 ERUs of capacity. He added that up to 400 units, <br />including the commercial area, could be connected eventually. The <br />County will bill the City of Sebastian, which will then bill the <br />individual customers. <br />28 <br />1 <br />
