BARKETT <br />For the Firm <br />Attorney Barkett explained that in 1985, as part of the Hawk's <br />Nest Golf Club site plan approval process, the developer was <br />required to enter into an agreement with the County to pay for a <br />portion of Storm Grove Road and assume responsibility for any <br />maintenance costs for the railroad crossing at the entrance to the <br />project. The developeiq is now turning the Hawk's Nest Golf Club <br />over to the members and the proposed resolution approves the <br />assignment of the developer's agreement to the members. <br />ON MOTION by Commissioner Eggert, SECONDED by <br />Commissioner Tippin, the Board unanimously adopted <br />Resolution 93-150, formally approving assignment of <br />developer's agreement relating to Hawk's Nest. <br />RESOLUTION NO. 93- 150 <br />A RESOLUTION OF INDIAN RIVER COUNTY, FLORIDA <br />FORMALLY APPROVING ASSIGNMENT OF DEVELOPER'S AGREEMENT <br />RELATING TO HAWK'S NEST <br />WHEREAS, Indian River County entered into a Developer's <br />Agreement with Vero Sand Pines on October 2, 1985, which <br />Developer's Agreement was amended by that Amendment to Developer's <br />Agreement dated September 11, 1986; and <br />WHEREAS, Hawk's Nest Management, Inc. is the holder of the <br />same Developer's Aunt by assignment; and <br />WHEREAS, Hawk's Nest Management, Inc. wishes to assign to <br />Hawk's Nest Golf Club, Inc. all rights, duties and obligations <br />arising under that Developer's Agreement, and Hawk's Nest Golf <br />Club, Inc. wishes to assume the same rights, duties and obligations <br />as set forth in the Developer's Agreement; and <br />34 <br />
