SEP 7 1993 <br />BOOK 90 `'QBE87 <br />right-of-way clearing was somewhat different from single family lot <br />clearing. Since the County bought the air curtain incinerator, we <br />have been using it to dispose of right-of-way clearing debris on <br />projects such as the South County Park and Indian River Boulevard <br />Phase IV and we have saved substantial cost in disposal fees. Even <br />with the recent change in burning regulations, staff was under the <br />impression that right-of-way clearing was not included in the <br />restrictions. The contract was put out for bid and awarded before <br />the realization that the material could not be removed to a <br />location not far from the right-of-way. After the bids came in for <br />the relocation of the Wentworth Ditch, Public Works communicated <br />with legal staff and Emergency Services Management and a decision <br />was reached that moving the material from one location to another <br />to burn the material was contradictory to the changes in the <br />burning regulations as adopted on May 18. As a result staff tried <br />to amicably remedy the situation because the contractor wanted a <br />substantial change order to handle the cost of debris removal. The <br />debris which will be processed with the chipper is only a portion <br />of debris to be cleared. Large stumps will not be handled by the <br />chipper and large -trunk pine trees will be sent to a logging <br />company. The chipped or mulched material will be used in various <br />locations. The SWDD staff thought the chipper could be made <br />available to Public Works for a fee. The dollars and cents have <br />not been worked out because we do not know how productive the <br />chipper will be. The plan is to use the chipper for a week or two <br />to see how quickly the contractor can load the chipper and dispose <br />of the material under 6 inches in diameter. Then we would move <br />into the process of a change order and arrive at a fair price to <br />both the County and the contractor. This procedure would result in <br />less delay to the entire road project. This procedure has been <br />used in other situations where we find that it is mutually <br />beneficial to the County and the contractor. <br />In response to Mr. Dill's first option, Director Davis <br />expressed the opinion that Sheltra & Son's price is excellent and <br />was based on running an air curtain incinerator for $6,000. Staff <br />does not know of a chipper that is available for the contractor to <br />rent. If SWDD's chipper is used, it would be fair to the <br />contractor and advantageous to the County since the entire project <br />is funded by impact fees. In response to Mr. Dill's second option, <br />Director Davis stated that it requires time and effort to prepare <br />bid documents. He was sure that SWDD and Public Works can arrive <br />at a fair price for the work. <br />50 <br />
