F,r-- <br />,Fp <br />BOOK 90 FAG1E599 <br />DESCRIPTION AND CONDITIONS: <br />The County has been petitioned by Duane E. Reynolds II and John J <br />Kone, owners of the subject property, for the release of a four (4) <br />foot portion of the northerly ten. (10) foot utility easement of Lot <br />91 Catalina Oaks P.R.D.. It is the petitioners' intention to <br />construct an addition to an existing single-family residence on the <br />subject property. <br />The current zoning classification of the subject property is RM -10, <br />Multi -family Repidential District, allowing up to ten (10) units <br />per acre. <br />ALTERNATIVES AND ANALYSIS: <br />The request has been reviewed by Southern Bell Telephone Company, <br />Vero Beach Power Company, T.C.I Cable Corporation, the Indian River <br />County Utilities Department and the Road & Bridge and Engineering <br />Divisions. Based upon their reviews it has been determined that <br />there would be no adverse impact to utilities being supplied to the <br />subject property. <br />RECOMMENDATION: <br />Staff recommends to the Board, through the adoption of a <br />resolution, release of a four (4) foot portion of the northerly ten_ <br />(10) foot utility easement, being the southerly four (4) feet of <br />the northerly ten (10) feet of Lot 9, Catalina Oaks P.R.D., <br />according to the plat thereof as recorded in Plat Book 13, Pages 7, <br />7A, & 7B of the Public Records of Indian River County, Florida. <br />and <br />ON MOTION by Commissioner Eggert, SECONDED by <br />Commissioner Adams, the Board unanimously adopted <br />Resolution 93-166 abandoning a portion of certain <br />easements on Lot 9, Catalina Oaks P.R.D., as <br />recommended by staff. <br />RESOLUTION NO. 93-166 <br />A RESOLUTION OF INDIAN RIVER COUNTY, FLORIDA <br />ABANDONING A PORTION OF CERTAIN EASEMENTS ON LOT <br />9, CATALINA OAKS P.R.D., ACCORDING TO THE PLAT <br />THEREOF AS RECORDED IN PLAT BOOK 13, PAGES 7, 7A & <br />7B OF THE PUBLIC RECORDS OF INDIAN RIVER COUNTY, <br />FLORIDA <br />WHEREAS, Indian River County has easement as described below, <br />WHEREAS, the retention of those easements serves no public <br />purposes, <br />NOW, THEREFORE, BE IT RESOLVED by the Board of County <br />Commissioners of Indian River County, Florida that: <br />This release of easement is executed by Indian River County, <br />a political subdivision of the State of Florida, whose mailing <br />address is 1840 25th Street, Vero Beach, Florida 32960, Grantor, to <br />4 <br />
