constructing the required sidewalk and/or bikeway or transferring the <br />obligation to construct the sidewalk and/or bikeway to the County by <br />providing a cash payment equal to 100% of the cost, and executing an <br />agreement for that transfer. <br />We wish to avoid the necessity of bringing before the Board each one of <br />these agreements on every site plan, planned development and subdivision <br />which elects this option. The Resolution attached authorizes the Public <br />Works Director or his designee to execute the agreement on behalf of the <br />County. A sample agreement is attached. <br />RECOMMENDATION: <br />Approve the attached Resolution authorizing the Public Works Director or his <br />designee to execute agreements for the transfer of responsibility for <br />required sidewalk and/or bikeway improvements. <br />Attorney Collins explained that the reason he wanted this item <br />pulled for discussion was that we received an executed agreement <br />from Macho last Friday regarding transfer of sidewalks and he would <br />like the Board to ratify that agreement even though it was prior to <br />this resolution. <br />ON MOTION by Commissioner Tippin, SECONDED by <br />Commissioner Eggert, the Board unanimously ratified <br />the agreement with Macho Properties, as recommended <br />by staff, and adopted Resolution 93-172A, delegating <br />the authority to execute agreements for the transfer <br />of responsibility for required bikeway and sidewalk <br />improvements to the Public Works Director or his <br />designee. <br />13 <br />BOOK 90 F'.kGF V2 <br />CT 5199 <br />
