Chandler, <br />County Administrator <br />FROM: James -W. Davis, P.E., <br />Public Works Director <br />SUBJECT: CR512 Clearing Disposal <br />DATE: September -29, 1993 FILE: CR512CLR.AGN <br />DESCRIPTION AND CONDITIONS <br />As requested by the Board of County Commissioners on Sept. 14, <br />1993, staff met on Sept. 28, 1993, with the CR512 Clearing <br />Contractor, Sheltra and Sons, and the Attorneys representing <br />Sheltra and Sons (Scott Kramer of Kramer, Ali, and Lambert), to <br />present an offer of $5,000 in additional compensation for the <br />disposal of the clearing material along CR512. <br />The Contractor's Attorney presented the attached list of additional <br />expenses totaling $49,460, which the Contractor claims has accrued <br />due to time delays on disposing of the cleared material. During <br />the Sept. 28, 1993 meeting, the Contractor and his Attorney <br />indicated that the $5,000 was not acceptable. <br />RECOMMENDATIONS AND FUNDING <br />To resolve the matter, the County Attorney's Office has recommended <br />voluntary mediation before former Judge Daniels on Friday, Oct. 1, <br />1993. Following the mediation, staff would request presenting to <br />the Board of County Commissioners the agreed upon proposal, if a <br />resolution is forthcoming. <br />28 <br />
