Request toend the <br />Comprehensive Plan to Redesignate Approximately�159 acres <br />from R to L-1 (LURA 93-07-0170) <br />It is requested that the data herein presented be given formal <br />consideration by the Board of County Commissioners at their regular <br />meeting of December 7, 1993. <br />DESCRIPTION AND CONDITIONS <br />This is a -request to change the land use designtion of <br />approximately 159 acres from R, Rural (up to 1 unit/acre} to L-1, <br />Low -Density Residential -1 (up to 3 units/acre). The subject <br />property is owned by Sebastian Grove Holdings, Ltd. A concurrent <br />rezoning is not part of this request. <br />Located at the northwest corner of C.R. 510 (Wabasso Road) and 82nd <br />Avenue, the subject property extends more than half a mile, north of <br />C.R. 510. In fact, a portion of the subject property's northern <br />boundary abuts the St. Sebastian River which forms the border <br />between the City of Sebastian and the unincorporated prtion of <br />Indian River County. A seven acre tract containing two ou -parcels <br />that are not part of the subject property fronts C.R. 10. The <br />purpose of this request is to secure the land use designation <br />necessary for developing the property with residential u es at up <br />to 3 units/acre. <br />On October 14, 1993, the Planning and Zoning Commission +voted 3-2 <br />to recommend that the Board of County Commissioners tra smit the <br />proposed land use amendment to the state Department of ommunity <br />Affairs (DCA) for their review. Although a majority of Planning <br />and Zoning Commissioners present voted in favor of the mendment <br />request, Section 103.02.12 of the County Code of aws and <br />Ordinances states that any matter or application consid red by a <br />board or commission with more than five members must rec.ive four <br />or more votes for passage. Since the Planning and Zoning <br />Commission has seven members and the subject application received <br />only three affirmative votes, the favorable reco endation <br />technically failed. <br />27 <br />BOOK 9A PAGE 129 <br />�� <br />-71993 <br />
