SECTION 8: CONSTRUCTION OF WALLS AND FENCES IN EASEMENTS <br />Planning Director Stan Boling made the following presentation: <br />S. SECTION 8: CONSTRUCTION OF WALLS AND FENCES IN EASENENTS <br />Current county LDRs [section 917.06(12)(A)] prohibit construction <br />of walls and fences in public easements, except in agricultural <br />districts where the easement holder (public authority) consents to <br />such construction. However, in addition to the "agricultural <br />exemption", the county has a long-standing practice of approving <br />covenants for removal of structures in easements, whereby <br />construction in easements is approved with conditions. Thus, <br />section 917.06(12)(A) needs to be modified to reference the <br />covenant for removal of structure exception, which is already being <br />applied. Proposed amendment section S. would make such a <br />modification. <br />Planning staff and the PSAC both recommend that the Board of County <br />Commissioners adopt the proposed amendment, as presented. On a 4-0 <br />vote, the Planning and Zoning Commission recommended adoption of <br />the proposed amendment. <br />The Vice Chairman opened the public hearing and asked if <br />anyone wished to be heard on this section. There being none, he <br />closed the public hearing. <br />The Vice Chairman announced that the consensus of the Board <br />was to follow staff's recommendation. <br />SECTION 9: COASTAL DEVELOPMENT <br />Planning Director Stan Boling made the following presentation: <br />9. SECTION 9: COASTAL DEVELOPMENT <br />Staff is proposing changes to LDR Chapter 932, relating to sea <br />turtle protection and dune crossover regulations. These changes are <br />proposed to make County regulations more consistent with State <br />guidelines and rules pertaining to these topics. <br />Dune crossover regulations (section 9A): the State has no defined <br />height maximum for dune crossover walkways. The proposed Chapter <br />932.LDR revision relating to dune crossover design deletes a 30 <br />inch average height limit presently in the County Code for such <br />walkways. This revision allows more flexibility in walkway design <br />to serve the objective of dune. vegetation protection, and is <br />consistent with State guidelines and regulations. <br />33 <br />DEC <br />BOOK 91 fAGE305 <br />
