ON MOTION by Commissioner Macht, SECONDED by ' <br />Commissioner Eggert, the Board unanimously (4-0, <br />Chairman Bird being absent) adopted Resolution 93- <br />218, providing for certain paving and drainage <br />improvements to 126th Street between 78th and 79th <br />Avenues, etc. <br />ON MOTION by Commissioner Macht, SECONDED by <br />Commissioner Eggert, the Board unanimously (4-0, <br />Chairman Bird being absent) adopted Resolution 93- <br />219, setting Tuesday, January 18, 1994 for a public <br />hearing -on the proposed paving to 126th Street <br />between 78th and 79th Avenues, etc. <br />Providing (First Reso.) 5/26/93(ENG)RESI.MAG\gfk <br />RESOLUTION NO. 93- 218 <br />A RESOLUTION OFTHE BOARD OF COUNTY COMMISSIONERS OF <br />INDIAN RIVER COUNTY, FLORIDA, PROVIDING FOR CERTAIN <br />PAVING AND DRAINAGE IMPROVEMENTS TO 126TH STREET <br />BETWEEN 78TH AVENUE AND 79TH AVENUE (ELAINE STREET) IN <br />ROSELAND LAKES SUBDIVISION, PROVIDING THE TOTAL <br />ESTIMATED COST, METHOD OF PAYMENT OF ASSESSMENTS, <br />NUMBER OF ANNUAL INSTALLMENTS, AND LEGAL DESCRIPTION <br />OF THE AREA SPECIFICALLY BENEFITED. <br />WHEREAS, the County Public Works Department has been petitioned for Road <br />Paving and Drainage Improvement for 126th Street between 78th Avenue and 79th Avenue (Elaine <br />Street) in Roseland Lakes Subdivision. <br />WHEREAS, the construction of paving and drainage improvements by special <br />assessment funding is authorized by Chapter 206, Section 206.01 through 206.09, Indian River <br />County Code; and cost estimates and preliminary assessment rolls have been completed by the <br />Public Works Department; and the total estimated cost of the proposed paving and drainage <br />improvements is THIRTY-TWO THOUSAND SIX HUNDRED SEVENTY-SIX DOLLARS and <br />FIFTY-SIX CENTS ($32,67656); and <br />WHEREAS, the special assessment provided hereunder shall, for any given record <br />owner of property within the area specially benefited, be in an amount equal to that proportion of <br />seventy-five percent (75%) of the total cost of the project ($24,507.42) which the number of parcels <br />owned by the given owner bears to the total number of parcels within the areas specially benefited <br />and twenty-five percent (25%) of the total cost of the project ($8,169.14) will come from Petition <br />Paving Account; and . <br />WHEREAS, the special assessment shall become due and payable at the Office of <br />the Tax Collector of Indian River County ninety (90) days after the final determination of the special <br />assessment pursuant to Section 206.08, Indian River County Code; and <br />3.9 <br />BOOK 91 F-vuF 9?9 <br />L_ DEC 211993 J <br />
