changes. Public Works staff have reviewed and accepted the traffic <br />analysis. Therefore, in staff's opinion the traffic impacts <br />resulting from requested changes are acceptable and no additional <br />D.O. traffic conditions are necessary. It should be noted that the <br />existing D.O. will continue to contain a traffic monitoring <br />conditions, whereby no project building permits will be issued <br />beyond the traffic analysis build -out date (1998) unless and until <br />the project's traffic analysis is again updated. <br />County staff have no objection to approval of the NOPC request. <br />RECOMMENDATION: <br />Staff recommends that the Board of County Commissioners: <br />1. Determine that the request does not constitute a substantial <br />deviation. <br />- 2. Adopt the attached resolution amending the Harbor Town Center <br />D.O. to allow the requested changes as described in the NOPC <br />request and in this report. <br />The Chairman opened the public hearing and asked if anyone <br />wished to be heard in this matter. <br />Steve Henderson, attorney for the developers, asked if the <br />Board had any questions. Commissioner Eggert asked, and Attorney <br />Henderson clarified that there have been no changes within the <br />development firm with the exception of Mr. Kuhn becoming a partner <br />about 2 years ago. <br />It was determined that no one else wished to be heard and the <br />Chairman closed the public hearing. <br />ON MOTION by Commissioner Adams, SECONDED by <br />Commissioner Eggert, the Board unanimously adopted <br />Resolution 94-1, amending the development order <br />(D.O.) approved by the Board of County Commissioners <br />for the Harbor Town Center Mall Development of <br />Regional Impact (D.R.I), as recommended by staff. <br />001 <br />JAN 4 1994 BOOK 91 pnu 373 <br />L <br />
