OWNERSHIP OF ABANDONED DUBOSE CEMETERY IN GIFFORD <br />The Board reviewed the following memo dated December 28, 1993: <br />TO: Board of County Commissioners <br />FROM: Terrence P. December 28, 1993 <br />RE: OWNERSHIP OF CEMETERY IN GIFFORD <br />BACKGROUND <br />There is an abandoned cemetery in Gifford located north of 45th <br />Street between 28th Court and 29th Avenue near Middle Sixth and <br />Middle Seventh. Several months ago Commissioner Eggert asked this <br />office for a report on the ownership of this land. <br />Recently, I have been contacted by G. Russell Petersen, . Attorney for <br />the School Board, as to ownership of the property as the School Board <br />may have an interest due to the proximity of the land to the schools.. <br />Several days ago Commissioner Adams expressed an interest in the land <br />and possible County uses. <br />In view of the several interests, staff feels that the matter should be <br />reviewed by the full Board and direction given to the staff as how to <br />proceed. <br />HISTORY OF OWNERSHIP <br />The record title holder of the above described property is shown as the <br />Vero Beach Cemetery Association, Inc., a corporation not for profit. A <br />search of Florida corporate records does not show this as viable <br />corporation or any past history as a corporation. The Vero Beach <br />Cemetery Association Inc. obtained title from Vero Beach Burial Park <br />Inc. by deed dated July 7, 1941. Vero Beach Burial Park obtained title <br />from Florida Burial Park Inc. by deed dated February 15, 1929. There <br />Is no record of a Vero Beach Burial Park Inc. in the corporate records <br />of the state of Florida. Florida Burial Park Inc. appears to have been <br />dissolved December 14, 1936. <br />In order to trace the history, the following table may be easier to <br />follow than the narrative above. <br />Florida Burial Park, Inc. - Root of Title <br />to <br />Vero Beach Burial Park, Inc. - Deed February 15, 1929 <br />to <br />Vero Beach Cemetery Association, Inc. - Deed July '7, 1941 <br />The 1941 Quitclaim deed from Vero Beach Burial Park to the Vero Beach <br />Cemetery Association list as trustees of the Vero Beach Burial Park <br />Company J.C. DuBose, A.E. DuBose, and O.L. DuBose. There are no <br />references available as to the officers or directors of the current record <br />title holder Vero Beach Cemetery Association Inc. or that it ever <br />existed as a corporation. <br />Because of the declared not for profit status that attached to this <br />property it has never been on the tax roles.
