O'Brien - Assistant County Attorneyc�o <br />DATE: December 30, 1993 <br />RE: PUBLIC HEARING - January 11, 1994 <br />SUBJECT: PROPOSED ORDINANCE ENTITLED: <br />AN ORDINANCE OF THE BOARD OF COUNTY <br />COMMISSIONERS OF INDIAN RIVER COUNTY, <br />AMENDING CHAPTER 103, COMMISSIONS AND <br />BOARDS, OF THE CODE OF INDIAN RIVER <br />COUNTY, TO IMPLEMENT SECTION 112.3143 (5) , <br />F.S. , CONCERNING VOTING CONFLICTS AND TO <br />REMOVE THE APPEARANCE OF IMPROPRIETY BY <br />COMMISSION, BOARD OR COMMITTEE MEMBERS <br />CONCERNING VOTING CONFLICTS. <br />This item came before the Board on December 7, 1993 (by Commissioner <br />Fran Adam's memorandum dated November 24, 1993) and was approved <br />for public hearing. The attached ordinance amends Chapter 103, <br />Commissions and Boards, to implement Section 112.3143(5), Florida <br />Statutes, concerning voting conflicts and to remove the appearance of <br />impropriety by commission, board, or committee members concerning <br />voting conflicts. <br />REQUEST: Staff recommends approval of the attached proposed <br />ordinance. <br />Attorney Vitunac explained that this ordinance requires the <br />Board to consider how many times a person has been absent when <br />reappointing people to boards. It also forbids members of boards <br />from stepping down and representing another party before their own <br />board. <br />Commissioner Bird agreed with the proposed ordinance as far as <br />someone stepping down and representing themselves or a client while <br />being part of that board because it does put the remaining members <br />of that board in somewhat of an uncomfortable position. However, <br />we are still a small community and if we are going to have people <br />on these committees who are actively involved in the community, <br />both business -wise and socially, it follows that there will be <br />periodic conflicts of interest. As long as the law is followed and <br />conflict of interest forms are filed, he would hate to see us <br />discourage people from serving <br />think this ordinance does that, <br />on these committees. <br />however. <br />38 <br />He didn't <br />� � r <br />
