The Board reviewed the following memo dated 1/3/94: <br />TO: James Chandler <br />County Administrator <br />THROUGH: James W. Davis, P.E. <br />Public Works Director <br />and <br />Roger D. Cain, P.E. <br />County Engineer <br />FROM: <br />Michelle A. Gentile, C.E.T. <br />Civil Engineer <br />SUBJECT: Public Hearing for the Paving & Drainage Improvements to 126th Street between <br />78th Avenue & 79th Avenue (Elaine Street) <br />DATE: January 3, 1994 <br />On December 21, 1993 the Board of County Commissioners adopted Resolution No. 93-218 <br />providing for certain paving and drainage improvements to 126th Street between 78th Avenue & <br />79th Avenue (Elaine Street). A petition was received from the property owners on this road and <br />property owners owning 69% of the front footage have signed this petition. The Public Works <br />Department met with the property owners in the benefited area as previously stated in the agenda <br />item for the Providing Resolution. <br />On December 21, 1993 the Board of County Commissioners adopted another Resolution 93-219 <br />setting the date and time for a Public Hearing to discuss the advisability, cost and amount of the <br />assessment against each property owner. This hearing is scheduled for January 18, 1994. <br />It is recommended that motions be made to approve the assessment roll, and confirming resolution <br />with changes, if any, made after input at the January 18, 1994 Public Hearing. Revised confirming <br />resolution and assessment roll will be forwarded to Chairman of the Board for signature. The <br />Assessment Roll and assessment plat are on file with the Clerk to the Board of County <br />Commissioner's office. <br />Civil Engineer Michelle Gentile distributed copies of a letter <br />from Louis Simonye protesting a full assessment of his property <br />because he believed he would not benefit from the improvements <br />which will terminate at Elaine Street and not even touch his <br />property. <br />Chairman Tippin opened the Public Hearing and asked if anyone <br />wished to be heard in this matter. <br />15 <br />BOOK 91 .
