Under our bidding procedures and given the facts addressed <br />herein, either newspaper could be selected as a matter of law. The <br />above information is presented to assist in making that <br />determination. If Sun is selected then the declaratory action to <br />determine their legal status would be necessary. <br />Administrator Chandler reported that the Press Journal's bid <br />is 30% lower than the rate charged last year, and the Sun's bid is <br />50% lower. Based on a total expenditure last year of approximately <br />$18,000 on legal advertisements, the total savings would be $5,400 <br />for the Press Journal and $9,000 for the Sun. The County spent a <br />little over $15,000 on display advertising, and the savings would <br />be $4,500 under the Press Journal's new rate and $7,600 under the <br />Sun's rate. <br />Commissioner Adams commented that the difference in rates can <br />be attributed to the Press Journal's wider circulation and the fact <br />that it is a daily newspaper. <br />Commissioner Eggert inquired about asking the Court for a <br />declaratory judgment on the legality of using the Sun, but <br />Commissioner Macht felt that would be a moot question if the Board <br />decides today to select the Press Journal. <br />MOTION WAS MADE by Commissioner Adams, SECONDED by <br />Commissioner Eggert, to award the bid for <br />publication of legal notices to the Vero Beach Press <br />Journal, as recommended by staff. <br />Under discussion, Administrator Chandler noted that by going <br />through the bidding process we were able to get a better rate from <br />the Press Journal for all our advertising. <br />Chairman Tippin commented that competition is a wonderful <br />thing. <br />Commissioner Adams suggested that we consider using the Sun in <br />the future, especially if the Sun's circulation keeps increasing. <br />Commissioner Macht pointed out that we could select the Press <br />Journal for our legal advertising and publish other display <br />advertisements in the Sun. He felt that we should insist that the <br />Press Journal publish the BCC meeting agendas on the County news <br />page. <br />Administrator Chandler advised that Press Journal staff is <br />supposed to position the agenda in the County section whenever <br />possible, but obviously they have not always done so. <br />7 <br />�� m ��� BOOK 91 FACE �� <br />
