Attorney Ralph L. Evans, representing the applicant, agreed <br />that the access road is not an issue to be discussed at a public <br />hearing to consider rezoning. He assured the Board that all <br />parties, including the DOT, have been aware of the problem of <br />limited access. Part of the site plan recommendation is to make <br />access available to everybody, and Mr. Evans assured the Board that <br />the applicant is attempting to do that. <br />It was determined that no one else wished to be heard and the <br />Chairman closed the public hearing. <br />MOTION WAS MADE by Commissioner Eggert, SECONDED by <br />Commissioner Adams, to adopt Ordinance 94-05, <br />amending the zoning ordinance and the accompanying <br />zoning map from IL and A-1 to CG, for the property <br />located west of I-95 approximately 660 feet south of <br />SR -60, described herein, and providing for effective <br />date. <br />Under discussion, Commissioner Macht asked, and Director <br />Keating confirmed that the site plan recommendations include the <br />provision for a legal instrument or vehicle to accommodate access <br />from that roadway to adjacent properties, and staff will work with <br />the applicant to ensure that occurs. Staff's position is that the <br />design is the best it can be. Director Keating further assured the <br />Board that the access road problem can be worked out and will not <br />affect the applicability of the zoning. <br />THE CHAIRMAN CALLED FOR THE QUESTION. <br />It was voted on and carried unanimously (4-0, <br />Commissioner Bird having left Chambers after <br />declaring a conflict of interest). <br />ORDINANCE NO. 94-5 <br />AN ORDINANCE OF INDIAN RIVER COUNTY,,.
