convinced that Mr. Westerman's firm can competently complete the <br />services required. All the terms of the existing contract and its <br />addenda will remain in force. The services for Project I under the <br />agreement have been completed and there remains $105,213.56 in <br />uncompleted work under this agreement. <br />ALTERNATIVES AND ANALYSIS <br />Alternative 1: <br />Approve the subletting of the remainder of the CR 512 engineering <br />services to R. Wayne Westerman, Jr., P.E. and direct the Chairman <br />to sign the attached letters approving the subletting. <br />Alternative 2: <br />Not approve the subletting and direct staff to request proposals <br />for the remainder of the CR 512 engineering services. <br />RECOMMENDATION AND FUNDING <br />Staff recommends Alternative No. 1. <br />R. Wayne Westerman explained to the Board that the <br />professional liability insurance for this project in the original <br />contract with Lloyd & Associates and the successor firm will remain <br />in effect. Mr. Westerman stated that his firm, R. Wayne Westerman, <br />Jr., P.E., has general liability insurance as is required for small <br />businesses. <br />ON MOTION by Commissioner Macht, SECONDED by <br />Commissioner Bird, the Board unanimously approved <br />subletting the remainder of the CR -512 engineering <br />services to R. Wayne Westerman, Jr., P.E., as <br />recommended by staff. <br />REPORT ON STATUS OF UTILITY DEPARTMENT USE OF INDIAN RIVER FARMS <br />WATER CONTROL DISTRICT RIGHT-OF-WAY <br />Utility Services Director Terry Pinto advised the Board that <br />on March 10 the Utility Services Department applied for a permit to <br />use some right-of-way from Indian River Farms Water Control <br />District. The permit was denied because of new legislation which <br />requires that the District go through a notification procedure when <br />they dig near any utilities. The Utility Services Department <br />currently uses District right-of-way's and pays $1,200 per mile. <br />This eliminates the necessity of purchasing right-of-way for <br />installation of utilities. The specific permit which was denied <br />was for the major effluent line running from the South County plant <br />and it is important to get that project completed. Director Pinto <br />was sure this specific permit problem can be resolved with the <br />57 <br />BOOK1062- <br />MAR 221994 <br />
