Beating,C7Dctor Community Developme t <br />THRU: Sasan Rohani, AICD s '� <br />Chief, Long -Ran a Planning <br />FROM: John Wachtel <br />Senior Planner, Long -Range Planning <br />DATE: March 30, 1994 <br />RE: BREWER INTERNATIONAL, INCORPORATED, REQUEST TO AMEND THE <br />COMPREHENSIVE PLAN TO REDESIGNATE APPROXIMATELY 6.4 ACRES <br />FROM L-1 TO AG -1. <br />PLAN AMENDMENT NUMBER: LUDA 93-07-0153 <br />It is requested that the data herein presented be given formal <br />consideration by the Board of County Commissioners at their regular <br />meeting of April 12, 1994. <br />DESCRIPTION AND CONDITIONS <br />This is a request to change the land use designation of <br />approximately 6.4 acres from L-1, Low -Density Residential -1 (up to <br />3 units/acre).to AG -1, Agricultural -1 (up to 1 unit/5 acres). Due <br />to the size and location of the subject property, this request does <br />not involve changes to the Urban Service Area (USA). A rezoning is <br />not part of this request. <br />Located on the south side of Sth Street, between 90th Avenue and I- <br />95, the subject property is owned by Brewer International, Inc. <br />The applicant manufactures agricultural products on the site. This <br />use is permitted as a special exception use in the existing A-1 <br />zoning district. <br />The applicant plans to eventually expand the structure on the site, <br />but cannot do so unless all special exception criteria for <br />agricultural businesses in the A-1 zoning district are met. One of <br />the special exception criteria for an agricultural business in the <br />A-1 zoning district is the requirement that the business be located <br />in an area designated as either agricultural or rural on the <br />comprehensive plan's future land use map. At the time the site was <br />developed, it had an agricultural land use designation and, <br />therefore, met this criterion. With the current L-1 land use <br />designation, however, the use is non -conforming and cannot be <br />expanded. By changing the land use designation of the site to an <br />agricultural designation, the existing business will again conform <br />to county land development regulations and may be expanded. <br />On October 14, 1993, the Planning and Zoning Commission voted 5 to <br />0 to recommend the transmittal of the proposed land use amendment <br />APR 121994 31 <br />
