Request to Amend the <br />Comprehensive Plan to Redesignate Approximately 159 acres <br />from R to L-1. <br />PLAN AMENDMENT NUNBER: LURA 93-07-0170 <br />It is requested that the data herein presented be given formal <br />consideration by the Board of County Commissioners at their regular <br />meeting of April 12, 1994. <br />DESCRIPTION AND CONDITIONS <br />This is a request to change the land use designation of <br />approximately 159 acres from R, Rural (up to 1 unit/acre) to L-1, <br />Low -Density Residential -1 (up to 3 units/acre). The subject <br />property is owned by Sebastian Grove Holdings, Ltd. A concurrent <br />rezoning is not part of this request. <br />Located at the northwest corner of C.R. 510 (Wabasso Road) and 82nd <br />Avenue, the subject property extends more than half a mile north of <br />C.R. 510. In fact, a portion of the subject property's northern <br />boundary abuts the St. Sebastian River which forms the border <br />between the City of Sebastian and the unincorporated portion of <br />Indian River County. A seven -acre tract containing two out -parcels <br />that are not part of the subject property fronts C.R. 510. The <br />purpose of this request is to secure the land use designation <br />necessary for developing the property with residential uses at up <br />to 3 units/acre. <br />On October 14, 1993, the Planning and Zoning Commission voted 3-2 <br />to recommend that the Board of County Commissioners transmit the <br />proposed land use amendment to the State Department of Community <br />Affairs (DCA) for their review. Although a majority of Planning <br />and Zoning Commissioners present voted in favor of the amendment <br />request, Section 103.02.12 of the County Code of Laws and <br />Ordinances states that any matter or application considered by a <br />board or commission with more than five members must receive four <br />or more votes for passage.
