ON MOTION by Commissioner Eggert, SECONDED by <br />Commissioner Adams, the Board unanimously limited <br />the rebid of this project to the three firms listed <br />above, stipulating that bids are -due within one week <br />after the bid information is ready. <br />27TH AVENUE RIGHT -OF -NAY ACQUISITION - LUCINDA EDDY PROPERTY NORTH <br />OF STH STREET <br />The Board reviewed the following memo dated 4/20/94: <br />TO:- James E. Chandler, <br />County Administrator <br />FROM: James W. Davis.,.P.E., <br />Public Works Director <br />SUBJECT: 27th Avenue Right -of -Way Acquisition - Lucinda <br />Eddy Property North of 8th Street <br />REF. LETTER: Randy L. Mosby -to Jim Davis dated April 14, 1994 <br />DATE: April 20, 1994 FILE: BDDY.A= <br />DESCRIPTION AND CONDITIONS <br />Mrs. Lucinda Eddy is developing a residential subdivision on a 3.28 <br />acre tract of land on the east side of 27th Avenue north of The <br />Redeemer Lutheran Church (between 8th Street and 12th Street). Due <br />to the future road widening, drainage, utility accommodations, and <br />-- pedestrian needs, an additional 25' x 487' of right-of-way is <br />needed along the property's frontage. The total right-of-way <br />parcel -size is approximately .28 acre from the parent parcel of <br />3.28 acres. <br />ALTERNATIVES AND ANALYSIS <br />Staff presented a proposal to purchase the .28 acre right-of-way <br />parcel for $12,167 which is $43,560 per acre. This price is not <br />acceptable to Mrs. Eddy, who is claiming that the sale of the .28 <br />acre right-of-way parcel will result in the loss,oftr�three building <br />lots. Mrs. Eddy is requesting $25,000, which iso J89,285.72 per <br />acre, due to the alleged loss of buildable lots. The minimum lot <br />size for the applicable zoning district (RS -6) is 7,000 square <br />feet. <br />Staff has .ronsidered the counter offer and have the following <br />concerns. <br />1) Comparable land sales in the area have not historically <br />reached $89,285 per acre. One third acre lots in the area <br />sell for $18,000 to $20,000. Undeveloped land is on the <br />market for $30,000 per acre. <br />2) The right-of-way parcel is currently encumbered by a 69 RV <br />--high voltage power line. <br />APR 26 1994 42 <br />BooK 92 card 5 <br />L_ J <br />
