INDIAN RIVER FARMS WATER -CONTROL DISTRICT - UTILITY PERMITTING <br />The Board reviewed the following memo dated 4/20/94: <br />DATE: APRIL 20, 1994 <br />TO: JAMES E. McCAI <br />AND STAFFED CAPITAL PROJECTS GINEER <br />BY: DEPARTMENT OF UTILITY SERVICES <br />SUBJECT: INDIAN RIVER FARMS UTILITY PERMITTING <br />BACKGROUND AND ANALYSIS <br />In March of 1994, the Utilities Department appeared before -the Board of <br />County Commissioners to discuss -an action taken by the Indian River <br />Farms Water Control District denying any further utility construction <br />within their right-of-ways. (See the attached agenda item dated March <br />21, 1994). At this meeting, the County agreed to support the district <br />_in changing the recently approved state law requiring -notification of <br />all utility companies prior to performing maintenance work within their <br />right-of-ways. Along with this commitment, the district attorney <br />indicated the district would work with the utilities department to <br />continue permitting its utility projects within the,F-ight-of-ways. <br />At the Indian River Farms Water Control' District meeting on April 14, <br />1994, the district put another utility construction permit on hold. <br />This is a critical project and is currently out to bid for <br />construction. We are now in front of the Board of County Commissioners <br />requesting assistance in resolving this problem immediately. <br />The staff of the Department of Utility Services recommends that the <br />Board of County Commissioners open appropriate dialogue with Indian <br />River Farms Water Control District to assist at arriving at an <br />expiditious conclusion to these problems. <br />50 BOOK 9 PArFF 30`3 <br />APR �� 19�� <br />
