DESCRIPTION AND CONDITIONS: <br />On December 20, 1993, on behalf of the Edward J. DeBartolo <br />Corporation, Greiner, Inc. applied for Development of'Regional <br />Impact (D.R.I.) approval for the Indian_River Mall project. The <br />project, which proposes development of a regional mall facility, a <br />community shopping center, and several principal commercial out - <br />parcels, is currently under review by the Treasure Coast Regional <br />Planning Council. Through the normal DRI review process, <br />jurisdictional agencies and county staff have reviewed the proposed <br />project and have provided comments to regional planning council <br />staff. Council staff are now preparing their report and <br />recommendation to the full Council. <br />Council staff have indicated to county planning staff that the full <br />Council should consider the DRI request at its June 17, 1994 <br />regular meeting. The county must now notify the planning council <br />as to the date of the hearing at which the D.R.I. request will be <br />considered by the Board of County Commissioners. Once the county <br />notifies the TCRPC of the county public hearing date, the TCRPC <br />will finalize and schedule the date of its hearing at which it will <br />consider the request and make its report and recommendations to the <br />county. <br />ANALYSIS: <br />The county is required to publish -the hearing date at least 60 days <br />in advance of the actual hearing. The hearing date should allow <br />enough time to receive the planning council's recommendation as <br />well as the recommendation of the Planning and Zoning Commission. <br />In addition to the DRI request, staff must schedule a public <br />hearing for the comprehensive plan amendment and rezoning requests <br />that are necessary for project approval. Therefore, the DRI <br />request should be scheduled for a time when;- at one meeting, the <br />Board of County Commissioners can consider and take final- action on <br />the comprehensive plan amendment, rezoning, and DRI requests. <br />A hearing date set for the July 19, 1994 regular Board of County <br />Commissioners meeting would meet the 60 day state notice <br />requirement and allow adequate review time for the _regional <br />planning council and the Planning and Zoning Commission. A July <br />19, 1994 hearing date would also- accommodate the Board's final <br />hearing on the project's comprehensive plan amendment and rezoning <br />requests. <br />RECOMMENDATION: <br />Staff recommends that the Board of County Commissioners set a time <br />certain public hearing date to consider the Indian River Mall DRI <br />request for the July 19, 1994 regular Board of County Commissioners <br />meeting. <br />ON MOTION by Commissioner Eggert, SECONDED by <br />Commissioner Adams, the Board unanimously scheduled <br />a public hearing for the regular BCC meeting July <br />19, 1994 to consider the Indian River Mall DRI <br />request. <br />3 <br />MAY 10 1994 <br />R00K r PAU.373 <br />I <br />
