Due to <br />its size and location, the subject property could be rezoned <br />without encroaching on the 200 acres of MED zoned property <br />surrounding the hospital. This MED district, comprising over 80% <br />of the node, would have enough size to protect and support the <br />hospital. In contrast, rezoning a large tract located in the <br />middle of the subject node would compromise the intent of the MED <br />zoning district. For this reason a MED to OCR rezoning would not <br />be appropriate for sites located in the middle of the node. Since <br />the subject property is located at the edge of the node, rezoning <br />the site to OCR would not compromise the intent of the MED <br />district. <br />Although the OCR district allows most uses permitted in the MED <br />district, rezoning the subject property from MED to OCR would allow <br />the applicant to develop the site with some uses that, while not <br />permitted in the MED district, are compatible with the site's <br />surroundings. For these reasons, the proposed rezoning is <br />appropriate. <br />CONCLUSION <br />The requested zoning is compatible with the surrounding area, <br />consistent with the goals, objectives, and policies of the <br />comprehensive plan, and meets all applicable concurrency criteria. <br />The subject property is located in an area deemed suitable for a <br />mix of office, restricted commercial, and residential uses. The <br />request meets all applicable criteria. Staff supports the request. <br />RECONNENDATION <br />Staff recommends that the Hoard of County Commissioners approve <br />this request to rezone the subject property from MED to OCR. <br />Chairman Tippin opened the Public Hearing and asked if anyone <br />wished to be heard on this matter. There being none, he closed the <br />Public Hearing. <br />ON MOTION by Commissioner Adams, SECONDED by <br />Commissioner Eggert, the Board unanimously adopted <br />Ordinance 94-14, rezoning from MED to OCR property <br />located on the north side of 37th street, approx. <br />167 feet west of the intersection of 37th Street and <br />Indian River Boulevard. <br />28 <br />
